Terms and Conditions

Important Notice: These Terms & Conditions constitute a legally binding agreement between you (the traveler) and Namaste Earth. By booking a trek, expedition, or guided tour, you confirm that you have read, understood, and agree to these terms on behalf of yourself and all members of your travel party.

1. Booking & Confirmation

  • All bookings are subject to availability and are confirmed only upon receipt of the advance payment (minimum 25% of the total trek/tour cost) and written confirmation from Namaste Earth.
  • The booking is considered provisional until payment is received. Namaste Earth reserves the right to cancel a provisional booking if payment is not received within the stipulated time.
  • A booking confirmation will be issued via email once the advance payment and required documents (including any medical/fitness declaration) are received.
  • Prices quoted are per person unless stated otherwise and are subject to change without prior notice until the booking is confirmed.

2. Payment Terms

  • Advance Payment: A minimum of 25% of the total trek/tour cost is required at the time of booking.
  • Full Payment: The remaining balance must be paid at least 1 week prior to the departure date.
  • For bookings made within 1 week of departure, 100% payment is required at the time of booking.
  • All payments should be made via bank transfer, UPI, or other approved payment methods as communicated by our team.
  • Namaste Earth is not responsible for any bank charges, exchange rate fluctuations, or transaction fees incurred during payment.

3. Cancellation Policy

  • Cancellations must be communicated in writing (email) to travel@namasteearth.com.
  • 45+ days before departure: 10% of the trek/tour cost will be deducted as processing fees.
  • 30–44 days before departure: 25% of the trek/tour cost will be deducted.
  • 15–29 days before departure: 50% of the trek/tour cost will be deducted.
  • 7–14 days before departure: 75% of the trek/tour cost will be deducted.
  • Less than 7 days or no-show: 100% of the trek/tour cost will be forfeited.
  • Cancellation charges are subject to the policies of transport operators, homestays/hotels, and other third-party suppliers, and may differ accordingly.
  • Namaste Earth reserves the right to cancel any trek or tour due to insufficient participation, unsafe weather/trail conditions, natural disasters, or force majeure events. In such cases, a full refund (or credit toward a future departure) will be offered.

4. Inclusions & Exclusions

  • Each trek/tour package clearly specifies what is included and excluded. Please review these carefully before booking.
  • Standard inclusions: accommodation/camping as mentioned, meals as specified, guiding and route support, permits and forest fees (where applicable), and common trekking/camping equipment as listed.
  • Standard exclusions: transport to/from the base point (unless specified), personal trekking gear, travel/medical insurance, personal expenses, tips & gratuities, porter/mule charges for personal luggage beyond the specified limit, and any services not listed in the inclusions.
  • Namaste Earth is not responsible for any additional costs arising from changes in itinerary due to force majeure, weather, or circumstances beyond our control.

5. Itinerary Changes

  • Namaste Earth reserves the right to alter the trek/tour itinerary, route, campsite, or any other arrangement at any time due to operational requirements, weather, trail conditions, or traveler safety.
  • In the event of itinerary changes, Namaste Earth will endeavour to provide comparable alternatives at no additional cost.
  • No refund will be provided if a traveler voluntarily opts out of any included activity, campsite, or sightseeing.
  • We reserve the right to cancel, advance, or postpone departures when minimum group size is not met.

6. Travel Insurance

  • Namaste Earth strongly recommends that all travelers purchase comprehensive travel/adventure insurance covering medical emergencies (including high-altitude evacuation), trip cancellation, loss of baggage, and personal liability.
  • Namaste Earth is not responsible for any loss, damage, or expense incurred due to the absence of travel insurance.
  • Travel insurance is not included in the package price unless explicitly stated.

7. Health, Safety & Conduct

  • Travelers are responsible for ensuring they are in adequate physical health and fitness to participate in trekking/expedition activities, and must disclose any medical conditions, allergies, or special requirements at the time of booking.
  • Namaste Earth reserves the right to exclude any traveler from participating in certain activities, or turn them back on the trail, if it is deemed unsafe for them or the group, including signs of altitude sickness.
  • Namaste Earth reserves the right to expel any traveler whose behaviour is deemed disruptive, offensive, or poses a risk to others. No refund will be provided in such cases.
  • Travelers are expected to respect local customs, communities, and the natural environment, and to follow Leave-No-Trace principles.

8. Liability & Responsibility

  • Namaste Earth acts as an organizer coordinating third-party suppliers (transport, homestays, porters, etc.) and is not liable for any loss, injury, damage, or additional expense arising from these third-party services.
  • Namaste Earth is not responsible for any loss, theft, or damage to personal belongings during the trek/tour.
  • Trekking and mountaineering carry inherent risk; travelers participate at their own risk and are advised to assess their own fitness and preparedness.
  • Our maximum liability is limited to the total amount paid for the trek/tour package.
  • Namaste Earth is not responsible for delays, accidents, injuries, or damages resulting from factors beyond our reasonable control, including natural disasters, weather, civil unrest, pandemics, or government actions.

9. Permits & Documentation

  • It is the sole responsibility of the traveler to carry valid government-issued photo identification and any documents required for the specific trek/region (e.g., permits for restricted areas).
  • Namaste Earth may assist with permit documentation but is not responsible if a permit application is denied.

10. Governing Law & Dispute Resolution

  • These Terms & Conditions are governed by the laws of India.
  • Any disputes arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Dharamshala, Himachal Pradesh, India.
  • Namaste Earth encourages dispute resolution through mutual negotiation before resorting to legal proceedings.

11. Amendments to Terms

  • Namaste Earth reserves the right to modify these Terms & Conditions at any time without prior notice.
  • The most current version of these terms will always be available on our website.
  • Continued use of our services after any changes constitutes acceptance of the updated terms.
